Court Enjoins Federal Contractor Vaccine Mandate Nationwide

Today, a federal district court judge in Georgia enjoined the federal contractor vaccine mandate nationwide. This may be welcome relief to federal contractors and subcontractors that were scrambling to comply with the broad mandate by January 4, 2022.

The Georgia federal court order issued today follows a Kentucky federal court injunction against the mandate last week in a case involving Kentucky, Tennessee, and Ohio. The plaintiffs in the Georgia case include the states of Georgia, Alabama, Idaho, Kansas, South Carolina, Utah and West Virginia, as well as several state governors and state agencies.

The states and agencies contend that the Biden administration does not have the authority to mandate vaccinations and that the mandate violates the U.S. Constitution. Finding that the parties would likely succeed in their claim, the federal court granted their request for a preliminary injunction.
