What Contractors Need to Know During a Shutdown
Quick Summary:
1.
Federal-aid contractors (highway, transit, airports, etc) - Programs funded by the Infrastructure Investment and Jobs Act (IIJA) would continue and be uninterrupted.
2.
Direct Federal contractors (Army Corps, General Services Admin, etc) - Construction contracts already awarded on a fixed-price basis will be substantially unaffected by the shutdown. However, for most cost-type contracts, time and materials contracts, IDIQ/MATOC/MACC contracts and those contracts that have yet to be awarded, the shutdown will likely suspend operations completely.

How Will the Government Shutdown Impact Federal Transportation Programs ?
Quick Summary:
1) According to the latest
U.S. Department of Transportation guidance, the Federal Highway Administration (FHWA) and Federal Transit Administration (FTA) should remain open. Generally, federal-aid funds should continue flowing on federal-aid highway, bridge and public transportation projects without interruption.
2) The continuity of
airport construction activity will depend on local airport authority decisions on how to manage their capital programs under the shutdown.
3) However, in the early hours of the current shutdown, the Department has announced a pause in funding for at least two large projects, stating the projects must be reviewed relative to the Disadvantaged Business Enterprise (DBE) program. However, staff in the Office of the Secretary of Transportation responsible for those tasks have been furloughed for the time being, resulting in the pause.
